In the current era data is considered the new oil which shows that how important a data could be for an organization or an individual. Recently India got its newly enacted data protection Act. The primary aim of this dissertation is to closely analyse the provisions of the newly enacted Digital Personal Data Protection Act, 2023 of India secondly it will also examine the concept of data privacy and why it is important in the today’s world of digitization. All the digital personal data which is collected digitally or which is digitized after collecting the data are governed by the Digital Personal Data Protection Act. “The notion of “personal data” in the DPDP is based on the criterion of identifiability of individuals, without consideration of nationality or residence, as is the case for the GDPR. On the other hand, the DPDP applies indiscriminately to all personal (digital) data without distinction; there are no special categories of data. Processing carried out for personal or domestic purposes and processing concerning personal data that are public or made accessible to the public, are excluded from the material scope.
